Reporting a Longshore (USL&H) Injury
Employees injured while engaged in maritime employment upon the navigable waters of the United States require the completion of Form LS-202. Timeliness is especially important with longshore reporting. If a report is filed after 10 days of the incident, employers will receive a “show cause” letter (Form LS-512) from the U.S. Department of Labor requesting an explanation of the untimely reporting. A written response must be submitted within 21 days to avoid a fine. Upon the employee’s return to work, the employer must also file Form LS-210, which also can be used to report a second period of disability. LWCC can assist with the completion and return of longshore forms.
